Terms and Conditions of Use for HomeBrew4Less.com Orders

We enjoy establishing long term relationships with our customers and work hard for your business. Our policies are pretty simple and we try to be fair and do the right thing and our policies can be summed up quickly by stating that if we screwed up, we will go above and beyond to fix it an our expense, if you screwed up, ordered the wrong item, did not fully understand what you were ordering, misunderstood a products intended use, misused or damage an item, or simply changed your mind about a purchase, don’t expect us to pay for your mistakes. We are all human, and mistakes sometimes happen, we will be responsible for ours and we expect you to be responsible for yours. That said lets clear some things up so there are no misunderstandings.

Standard Shipping (USPS/UPS/FedEx Ground/Home Delivery)
Orders that are successfully processed are shipped via UPS/FedEx Ground/Home Delivery or USPS. Usually delivers within three (3) to ten (10) business days within the contiguous U.S. However, there may be times during the year (often November and December) when there may be slight delays due to high shipping volume. HomeBrew4Less.com is not responsible for any shipping delays.

FedEx and UPS shipping are not available for orders to AK, HI, P.O. Box, and APO/FPO addresses. These orders must ship via United States Postal Service (USPS) Priority Mail. See below.

Alaska and Hawaii
FedEx and UPS Services are not available for Alaska (AK) and Hawaii (HI). Orders shipped to AK and HI must use the United States Postal Service (USPS) Priority Mail Service. USPS Priority Mail tries to ship within three (3) to four (4) business days (1-2 days to process + 2 days for shipping), but please allow up to fourteen (14) days for arrival. If you do not choose USPS for Alaska (AK) and Hawaii (HI) orders when you check out, your order will be canceled at our discretion.

P.O. Boxes and APO/FPO Addresses
FedEx and UPS Services are not available for P.O. Boxes and APO/FPO addresses. Orders shipped to P.O. Boxes and APO/FPO addresses must use the United States Postal Service (USPS) Priority Mail Service. USPS Priority Mail tries to ship within three (3) to four (4) business days (1-2 days to process + 2 days for shipping), but please allow up to fourteen (14) days for arrival. If you do not choose USPS for P.O. Boxes and APO/FPO addresses orders when you check out, your order will be canceled at our discretion.

International Locations and U.S. Territories
Unfortunately, we are not able to ship to international locations or to U.S. Territories. We apologize for this.

You will be billed when your order ships
Your credit/debit card will be charged once your order ships. When you place your order, we will put a Pending Authorization on your credit/debit card account for the entire amount of your order. A Pending Authorization means your card issuer will hold the funds pending shipment of your order. This will show up as a “Pending Transaction” on your account. Once we’ve shipped your order, your credit/debit card will actually be charged. If your order is being shipped from multiple locations or multiple shipments, you may see separate charges on your account for each shipment. If you make a payment via PayPal, PayPal will deduct your monies immediately when you place your order, regardless of when we can ship, and we have no control of that.

Because conditions of use are beyond our control, we make no warranty or representation, express or implied, except that all products conform to the description provided on sales literature or product labels. Our liability is limited to the purchase price paid.

To the best of our ability the photographs and illustrations on our web site are accurate and up-to-date.  However, we reserve the right to change or alter the actual product sold if it represents a better value to you, the costumer, or if the original product becomes no longer available.  For these reasons, all photographs and illustrations are for display purposes only.

Backordered /Special order Items
We work hard to keep up our warehouse inventory so that you get your products in good time; the date we expect to receive a backordered item is noted on the product description page on our website. We usually ship backordered and special ordered items within 7 to 15 days depending on which supplier the item is coming from, but once in awhile certain items may be backordered or unavailable from our distributors. In these cases we will hold your order for up to Thirty days if the backordered items are expected within that time.  After 30 days we will cancel back ordered items on your order unless you contact us and tell us to keep them on back order. We offer thousands of products from multiple distributors, and sometimes they have extended delays when they run out of a particular item. Our goal is to get your orders to you a quickly as possible so we also reserve the right to substitute a product of equal or better value at no additional cost to you if it means we can ship your order sooner.
You may cancel backordered items any time up to the shipment date by calling us during normal store hours.

About Shipping Live Liquid Yeast
Live Liquid yeast can be shipped to almost all locations, all year long.  If it's warm in your area, the yeast will probably be warm when it arrives.  Even with an ice pack, the yeast will probably warm up by the time you receive it.  The ice pack extends the refrigerated time, it doesn't last forever.
However, this isn't usually deadly to yeast.  It takes more than the hottest weather (even 110 degree days) to actually kill the yeast outright.  We have shipped many hundreds of yeast cultures to locations where they've been un-refrigerated for a week or more during transit.  This may weaken the culture somewhat, so fermentation starts a little slower, but you'll find that the quality of the beer is just fine.  Even better is that fact that most orders take less than a week in transit, and it's not that hot for most of the year!
In almost all cases when we're contacted about yeast that arrived "hot" - it ends up working fine.  You have to give it a chance.  We will not provide free replacement yeast on the mere suspicion of heat damage. We will also not replace yeast that was shipped without an ice pack. We always recommend you add an ice pack to your yeast order especially if you are more than two days transit time from us, and that you make a proper yeast starter to ensure your yeast is in good condition.

Dented Cans and Party Kegs
These items have traveled a long way, you need to be prepared for a few dents every once in a while!  We will only replace dented cans or Party Kegs if they are returned to us at your expense for shipping in both directions, and by your own arrangements.  We strongly suggest that you ignore the dents unless they are so severe that the can can't be opened or used.  If you have a serious damage situation, give us a call and we will attempt to resolve it on a case-by-case basis.

Refunds
So that we may continue to provide you extreme value, we do not offer refunds and consider all sales final and the customer is responsible for determining if the product(s) ordered suits their needs. However, in the rare event your order is incomplete, or your items arrived damaged, we will correct the problem. Simply call our Customer Order Support at (717) 504-8534 during normal store hours so we can determine the best way to resolve the matter.

If you purchase something from this web site you are agreeing to our Terms & Conditions that say "No Refunds" and you then report the charge as unauthorized - you would be committing something called "FRAUD" and will be reported to the appropriate authorities, sent to collections, and will be responsible for all costs incurred in collection, including but not limited to, legal and court fees

Damaged or Defective Items
Special note on glassware; we double check all glass items shipped, but no carriers will guarantee the safe delivery of glassware. We do our best to pack all orders for safe arrival, and they usually do, and we receive very few reports of broken glass items, but glassware, and glass bottles or other glass items are shipped at your own risk and no refunds will be issued for broken or damaged glass items.

If you have damaged or defective items in your order other then glass items, please contact us during normal store hours via  telephone at (717) 504-8534.  In some cases we can send a replacement immediately.
In some cases, at our discretion, we will require either a damage report from USPS, UPS, or Fedex, or that you return the damaged/defective item.  Your replacement will not ship until we receive and examine the damaged/defective item.  HomeBrew4Less.com is not responsible for the cost of return shipping, this would be no different then expecting a local retail store to pay you for gas to return an item.  In certain instances we may pay for return shipping, but this is strictly at our discretion and is not negotiable.

When returning damaged products, be sure to use a carrier that can provide you with a tracking number for your return. HomeBrew4Less.com will not be held responsible for returns that are lost in transit and/or do not have a proper tracking number.

We are not able to accept returns on damaged merchandise that was not inspected by the customer at the time of original delivery and not reported or claimed within 2 business days of receipt. If a customer signs for a delivery and does not report any damage to the shipping company or to us then it is the customer's responsibility to file a claim with the shipping company to recoup any damages.

Products returned as defective, but which after inspection, are found not to be defective or unauthorized return of undamaged items will be returned to the customer and the customer will be responsible for shipping charges going back to the customer.  If the customer fails to make arrangements for return shipping within 30 days, the returned items will be considered abandoned, and disposed in any manner that we deem necessary or proper without any reimbursement or liability. We are not responsible for unauthorized returns and abandoned orders shipped back to us. In such event, you will not be relieved of your liability to us. 

Refusal of Shipment
Except when a package is damage by a shipper, if a customer refuses goods that were to be delivered to them or a package is returned to us as undeliverable, then the customer will be responsible for both the shipping cost to send the package(s) to the customer and the shipping costs incurred by HomeBrew4Less.com to have the package(s) shipped back (returned) to our warehouse and we will also charge a 20% Handling Fee to cover our the additional costs of processing of the order.

On-Line Shipping calculator
Our online shipping calculator is acurate most of the time, but is some cases certian cominations of products, or large heavy items may not calculate properly. Also if a shiping method is not avaliable to you location, you will get erronious results, if the shipping rate seems rediculously to low, then it probobly is, we will not ship your order until we get your aproval and apply the correct shipping amount.

We reserve the right, in our sole discretion, to cancel any order or limit order quantity. We may request additional qualifying information prior to accepting or processing your order. In verifying your method of payment, shipping address and other information available to us, we may decide to cancel or otherwise reduce the quantity of your order.
